Can you do anything legal in KY for not being hired due to a false positive drug test?

I failed a drug test, urine analysis, and I know that I do nothing, so i was wanting to know if there is any legal action that I can take against the company that will not hire me because of the drug test. I can take a hair follicle test to prove that I have done nothing... When pre-employment drug screens are done and a positive test result occurs, the lab automatically does a second test from the sample provided by the person to rule out a possible ';false positive';. If the second test also comes back positive, then the employer is notified as such %26amp; you don't get hired.


If you are 110% sure that you had NOTHING in your system that would cause the test to come back as positive, then contact the company's HR Dept and ask them what your options are to contest the results.


And eating a muffin, bagel or sandwich that has poppy seeds on it will not cause the test to pop a false positive. The amount of poppy seeds coating the bread versus the amount required to register- you would be sick from overeating before that occured.Can you do anything legal in KY for not being hired due to a false positive drug test?
You can not sue the company if they consistently follow their drug testing policy. You at best can get an accurate test done and then sue the company that gave the false test for the cost incurred by you getting an accurate test. How is the company you are applying to doing anything wrong as long as they do not hire anyone that fails a drug test? It is not their fault.





If you think you can pass a hair test because you bleached your hair they are on to those kind of tricks if you show up with obviously treated hair they will use hair from a different part of your body.





I tend to believe false positive drug tests are like people in prison there are some innocent people but a very small percentage of those that claim it.





I don't mean to imply that you are not innocent just to advise you if you are looking for a way to beat the system it is not as easy as people think it is.

No company i know of, ever sends pre employment drug test, to a lab for verification of positive readings.





You might be able to approach the company, , and offer to pay for lab verification of your drug test..





Your problem is going to be, most company pre employment drug test, only measure drugs that have been gotten in your system, within the last couple of days.





They do not test positive for drug use that was weeks or months old, that would show up on a lab test.





And they destroy those urine samples immediantly.





So they would not still have them to verify by sending it to a lab.






take another drug test. don;t wait 3 months later, that won;t count. Besides, the machine has no clue what a false postive is. That's a human created term often used as a dodge to avoid what the machine says is correct. Your only chance is to claim eating poppy seeds in a muffin if the machine tested positive for opium. Else, turn out the lights, the party is over. %26lt; As the song goes......
Were you taking any non prescription drugs,over the counter medications, etc.??? And did you mention it to the testing center???
